There will be a reason they have refused shelter, either due to conditions and safety or mental health issues - in which those facilities may not be well enough equipped for. For those that need to turn down shelter, they should be abllowed to sleep on public property because they essentially have no choice. But we should be eliminating these issues, not criminalising homeless people.
