What if someone tries to rape someone and the victim hits them in the neck with a glass object, the glass breaks, rapist's jugular tears open and the rapist dies. I don't think the would-be victim should be punished at all.
I do think rapists (especially the most sadistic, deliberate and repeat offenders and those who prey on kids) should get the death penalty though.
